These Terms of Use (“Terms”) govern your access to and use of hospitalityexplained.com and the products, resources, downloads, tools, and services provided by Hospitality Explained LLC (“Hospitality Explained,” “we,” “us,” or “our”).

By accessing the website, creating an account, or purchasing or downloading a product, you agree to these Terms.

If you do not agree, do not use the website or purchase our products.

1. Educational Purpose

Hospitality Explained provides educational content, planning tools, operating resources, templates, workbooks, calculators, and related materials for hospitality professionals and businesses.

Our materials are provided for educational and informational purposes only.

They do not constitute legal, tax, accounting, financial, investment, architectural, engineering, employment, health, food-safety, licensing, insurance, lending, or other professional advice.

Restaurant and hospitality decisions are fact-specific and requirements vary by jurisdiction. You are responsible for obtaining qualified professional advice where appropriate and for confirming requirements with the authorities and professionals that govern your situation.

2. No Guarantee of Results

Business performance depends on many factors outside our control.

Hospitality Explained does not guarantee:

  • profitability;
  • financing approval;
  • permitting or licensing approval;
  • construction cost or completion dates;
  • business survival;
  • revenue, traffic, sales, or customer demand;
  • labor, food-cost, or operating results;
  • regulatory outcomes; or
  • any particular financial or business result from using our materials.

Examples, scenarios, frameworks, calculations, and illustrations are educational tools and should be adapted to your circumstances.

3. Purchases and Payment

Prices are displayed before purchase and may change from time to time.

Payments are processed through third-party payment providers, including Stripe.

You agree to provide accurate billing and account information and authorize the applicable payment provider to charge the amount shown at checkout.

Promotional offers, coupon codes, or discounts may be subject to separate restrictions, expiration dates, product limitations, or usage limits.

4. Digital Product Delivery

Paid digital products may be made available through the order-confirmation page, secure download links, customer account, email, or a combination of these methods.

You are responsible for providing an accurate email address and maintaining access to that email account.

5. License to Purchased Materials

Unless a product states otherwise, purchase of a Hospitality Explained digital product grants you a limited, non-exclusive, non-transferable, revocable license to use the material for your own personal professional use or for the internal operations of one business or organization that you own or work for.

You may print working copies and use the materials internally for legitimate business planning, training, implementation, or operating purposes.

You may not, without prior written permission:

  • resell, sublicense, redistribute, publish, upload, or commercially distribute the materials;
  • share purchased files publicly or with unrelated businesses or organizations;
  • reproduce the materials as your own product, course, template library, consulting deliverable, or commercial resource;
  • remove copyright, trademark, or proprietary notices;
  • use the materials to create a substantially similar product for resale or distribution; or
  • make the purchased files available through public file-sharing, membership, training, or download systems.

Team, multi-location, enterprise, training, or broader licensing rights may be offered separately.

6. Intellectual Property

The website and its original content, frameworks, text, graphics, product designs, downloads, templates, worksheets, branding, and other materials are owned by or licensed to Hospitality Explained and are protected by applicable intellectual-property laws.

“Hospitality Explained” and associated branding may not be used in a manner that suggests endorsement, affiliation, or authorization without written permission.

7. Accounts

Where account creation is offered, you are responsible for maintaining the confidentiality of your login information and for activity occurring through your account.

You agree to provide accurate information and to notify us if you believe an account has been accessed without authorization.

We may suspend or terminate accounts used for fraud, abuse, unauthorized distribution of products, security violations, or material violations of these Terms.

8. Acceptable Use

You may not use the website to:

  • violate applicable law;
  • interfere with the security or operation of the website;
  • attempt unauthorized access to accounts, systems, or data;
  • distribute malware or harmful code;
  • scrape, harvest, or misuse personal information;
  • engage in fraud or payment abuse; or
  • infringe the rights of Hospitality Explained or others.

9. Third-Party Services and Links

The website may rely on or link to third-party services.

Hospitality Explained is not responsible for the availability, content, policies, security, or independent actions of third-party websites and services.

10. Refunds

Digital-product refunds are governed by our Refund Policy, which is incorporated into these Terms by reference.

11. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the website and materials are provided “as is” and “as available.”

We disclaim warranties not expressly stated in these Terms, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the extent permitted by law.

12. Limitation of Liability

To the fullest extent permitted by applicable law, Hospitality Explained LLC and its owners, officers, employees, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to the website, products, or use of our materials.

To the fullest extent permitted by applicable law, our aggregate liability arising from a particular paid product will not exceed the amount you paid Hospitality Explained for that product.

Nothing in these Terms excludes liability that cannot lawfully be excluded or limited.

13. Changes to Products or Website

We may update, correct, improve, replace, discontinue, or modify website content and products from time to time.

Purchasing a product does not guarantee that future editions, revisions, updates, additional products, consulting, or services will be provided without additional charge unless expressly stated.

14. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except where applicable law requires otherwise.

15. Changes to These Terms

We may update these Terms from time to time. The current version will be posted on this page with its effective date.

Your continued use of the website after an updated version becomes effective constitutes acceptance of the revised Terms to the extent permitted by law.
